dzekunoi May 12, 2008 May 12, 2008 Ok guys, Recently I ordered a coral from a vendor. Everything looked so happy and upbeat until UPS dropped the ball, package got damaged and never delivered. I'm trying to get a refund from the vendor yet with no success. Not until UPS refunds the vendor :( Do not even get a store credit. GUARANTEE : We guarantee live arrival. However, we are not responsible for shipping delays. In order for a refund to be issued, we must be contacted within 2 hours of delivery and must receive a clear photograph (SPECIFY - OF WHAT??) within 24 hours. Failure by the customer to accept the package on the first delivery attempt will void this guarantee. Have no idea what to do now. Master buyers, any advice? Never had anything like this happening to me before. Usually refund is not an issue. :(

vaironman May 12, 2008 May 12, 2008 (edited) Carla, I would get the UPS to confirm that they never delivered the package in email or some sort of UPS ticket tracking system (if they have it). Get the ticket #, then give the # to your online vendor and have them refund right away. That's up to the vendor to work it out with UPS after UPS confirmed they are at fault. The vendor getting the $$$ back from UPS is their problem. Once it's determined no delivery has taken place (what does the UPS tracking say?) I'd expect an immediate refund. They give any hassles & I'd toast 'em.

CONTACT THE SENDER - you never got it to begin with!
wreck May 12, 2008 May 12, 2008 First thing is to actually speak to a manager or someone with some authority of the vendor and explain to them your situation in a calm and polite manner. If that fails to get you an immediate refund you can always file a non receipt of goods/services with your credit card company. Good luck.
magnetic1 May 12, 2008 May 12, 2008 As a vendor, I hate it when customers file credit card disputes, but this is one instance where it might be appropriate. Then again, it could also complicate things. If you file a dispute w/ the CC company, then they have to investigate, etc and makes the whole process longer as the CC company yanks $ out of the vendor's account. Id call UPS to make sure a claim has been indeed filed by the vendor. If not, then you know something is up. Typically it shouldnt take UPS/FedEx more than a week to resolve these types of issues. So IMHO, Id wait a week, follow up w/ the vendor and make sure they did get credit, etc. If they still refuse to refund you, then file a dispute w/ your CC company.
SteveD May 12, 2008 May 12, 2008 Just because they state on their website that they are not responsible for shipping delays does not make it true. I think it is fair to give them a week or so to get a credit from UPS, but put the screws to them after that. Tell them you'll dispute it with the credit card company if they don't resolve the problem for you in 3 days or something. The vendor is responsible for getting the item delivered to you. Especially when you paid them to do it.

If the problem will not be resolved by Friday then you will see a "nice" review here on the board. You know, I do not do this often but there are some instances when I would. The vendor is well aware of the situation with the UPS, got emails from them, talked to them etc. I'm just inpatient about my refund as I do not think it's fair to make me wait for UPS to send a refund check to the vendor. I do not think it should be connected as it's between the vendor and UPS to settle this.
Leishman May 12, 2008 May 12, 2008 I have never had an issue with this vendor, only smooth transactions (but this issue was caused by a bad delivery, not the vendor) that being said, I have had a delivery get stuck in TN and that vendor gave me a full refund.

Exactly right, there is NO reason why you should be waiting on the refund - it's the vendor's problem to deal with, period end of story. I would not be so kind.
Leishman May 12, 2008 May 12, 2008 Rik, I do not think you guessed the vendor right I think I'm correct......... Unless there are 2 vendors with the EXACT same GUARANTEE on their website. My shipment that got stuck was NOT from the one you are talking about, mine was reefermadness. Your vendor would not have to ship through TN....... All my buys from "a website" (that has the exact same guarantee on the site as you posted) went smoothly.
